What Do Public County Arrest Records Contain?

Mail requests may be made via U.S. Mail or third-party commercial carriers by sending a written request along with a self-addressed stamped envelope to the mail address provided above. Upon receiving the request, the requester will be contacted by the Deputy Clerk of Court. Fees may be charged in advance, ranging from $0.50 per page to $35.00 for certified copies.

If the arrest was carried out by a federal law enforcement agency, individuals may find case files through Public Access to Court Electronic Records (PACER) System, which allows registered users to search for arrest-related criminal case files by name or case number. Although registration is free, the user will be required to pay fees to view cases.

Yavapai County Arrest Report

Although similar, an arrest record and an arrest report are not the same thing. Arrest reports are official notations of an arresting officer detailing the circumstances of an individual’s arrest, booking, and subsequent detention in custody. How to Get an Arrest Record Expunged in Yavapai County

Expungement is the total erasure of an arrest record from all available databases, including databases managed by law enforcement and the courts. Except for certain marijuana-related offenses  as outlined in the Arizona Revised Statutes (ARS) § 36-2862, state law offers a more restricted form of expungement known as “Sealing.” Sealed records are redacted from every official database, except for those operated by law enforcement and the courts.

According to state law, anyone can request to have their arrest record expunged provided they have met the eligibility criteria stipulated by the law. By state law, individuals may petition for expungement under the following circumstances:

  • The arrest resulted in a conviction, but the arrested individual has subsequently served the imposed sentence, paid all fines, fees, and restitution that the court imposed.
  • Upon completing the imposed sentence and punishment, the individual has observed the waiting period, which typically varies depending on the seriousness of the offense; ten years for Class 2 and 3 felonies, five years for Class 4, 5, and 6 felonies, and two to three years for Class 1 or lower grade misdemeanors.
  • The individual was arrested and tried, but the case was subsequently dismissed or the individual was found not guilty.
  • If they were arrested for a crime but no subsequent charges were filed.

How Do You Remove Yavapai County Arrest Records From the Internet?

Yavapaie County arrest records are public records, meaning law enforcement and other authorized entities are allowed to publish them on the internet. However, these records may be withdrawn from the internet if certain conditions are met. The primary requirement for removing arrest records from the internet is a change in the legal status of the record.
